The National Resistance Movement (NRM) has gained the Nakawa Division II directly elected councillor seat after a magistrate’s court overturned the election of National Unity Platform (NUP) candidate Godfrey Luyombya and declared his rival, Emmanuel Kitosi, the rightful winner.

In a judgment delivered on October 29, 2026, Nakawa Chief Magistrate Adoko Joe Fay ruled that Kitosi had presented sufficient evidence to prove that electoral irregularities substantially affected the outcome of the January 22, 2026 poll.

The court found that the petitioner had demonstrated both non-compliance with electoral requirements and, through numerical evidence, that he had secured enough votes to be declared the winner.

Fay consequently nullified the Electoral Commission’s declaration of Luyombya as the duly elected councillor and ordered him to vacate the office immediately.

The Electoral Commission was directed to gazette Kitosi as the directly elected councillor for Nakawa Division II, Kampala District, with immediate effect.

“The petition succeeds in favour of the petitioner,” the judgment reads.

The court also awarded Kitosi costs of the petition against the respondents, including Luyombya and the Electoral Commission.

The judgment was delivered electronically through the Electronic Court Case Management Information System (ECCMIS), with the parties notified through their respective accounts.

The decision overturns the Electoral Commission’s earlier declaration of Luyombya as the winner and gives the NRM a seat in the Nakawa Division II council, following the successful election petition.
