The High Court in Kampala has granted unrestricted access to family members to visit city business mogul Mohan Musisi Kiwanuka following a legal dispute over his mental health.
This decision came after an application filed by his sisters Jalia Muwanga, Nantege Yudaya Nsereko, Berti Nsereko Kawooya, and Sarah Nsereko who sought a court ruling on their brother’s mental condition.
The applicants sought a review of the ruling in Miscellaneous Cause No. 82 of 2023, which had been dismissed on the ground of res judicata. They contended that the court erred by failing to consider new facts indicating the respondent’s deteriorating mental health, supported by affidavits from the respondent’s physicians and his counsel’s admission of his incapacity.
The applicants argued that the respondent’s lawyers lacked valid instructions to represent him, as he was declared mentally unfit to manage his affairs.
During the court proceedings before Justice Flavian Zeija, Kiwanuka’s lawyer, Francis Buwule, stated that his client is suffering from a mental illness.
Concerns Over Kiwanuka’s Health
In 2023, Muwanga and Nsereko raised concerns that their brother was battling Alzheimer’s disease, leading to severe cognitive decline. They claimed that despite his deteriorating condition, he was not receiving adequate care from his wife.
Nsereko, a retired dementia caregiver who worked with the National Health Service (NHS) in the UK, said she used her professional expertise to assess that her brother required urgent medical attention.
Reports indicate that Kiwanuka was first diagnosed with Alzheimer’s in 2017 by UK-based psychiatrist Dr. Farook Maniyar. At the time, the disease was in its early stages, and he was discharged after receiving treatment.
Later, when Kiwanuka returned to the UK, his condition reportedly improved. However, according to Nsereko, his wife, Maria Kiwanuka, allegedly neglected him, leaving early in the morning and returning late at night, while the maid was preoccupied with household chores.
By 2019, his condition worsened after he stopped visiting his UK-based doctor. His sisters, noticing his health decline, arranged to visit him daily.
Family Feud Over Wealth and Property
Kiwanuka’s deteriorating health reportedly led to disputes with his wife, Beatrice Luyiga Kavuma, and her children, particularly Jordan Sebuliba Kiwanuka.
Jordan allegedly embezzled money collected from Seven Trees Gardens in Kololo, along Dundas Road, depriving his siblings of their rightful share. His misconduct led his mother to evict him from her building on Kawalya Kagwa Road, forcing him to relocate to Bukoto.
This family controversy is not new. In 2019, Jordan filed a court case seeking control over his father’s properties, claiming that Kiwanuka had gifted the family assets to them but had since become too frail to remember. He argued that his father’s dementia had worsened over the years, severely affecting his cognitive abilities.
However, High Court Judge Sekaana Musa dismissed the application, ordering both parties to bear their legal costs. The court later found Jordan guilty of multiple offenses, leading to his eviction from two properties he had occupied illegally for over a decade.
Attempted Property Fraud
In the same year, Jordan attempted to sell his father’s property on Plot 10, Akii-Bua Road. He presented a sales agreement claiming he had received Shs 2.5 billion from businessman Victor Nuwagaba but had failed to repay the debt. He later sought Shs 1.5 billion from Nuwagaba in exchange for the property. However, the court blocked the transaction.
Kiwanuka’s Paternity Dispute
Mohan Kiwanuka has also made shocking claims about Jordan’s parentage. He alleges that his wife, Beatrice Luyiga Kavuma Kiwanuka, conceived Jordan during an affair with a man from Western Uganda while attending a conference in Entebbe.
Kiwanuka reportedly requested a DNA test to confirm Jordan’s paternity, but Beatrice refused. She allegedly insisted that Jordan was his son, leading Kiwanuka to raise him as his own.
New Power of Attorney
Due to his deteriorating health, Kiwanuka has granted powers of attorney to his wife Maria Nabasirye Kiwanuka, his son Eddin Musisi Kiwanuka, Bawa Batenda, and his uncle Dr. Muhammad Buwule Kasasa to manage his businesses.
